1. About us and these terms
1.1 New School BJJ Brixton is a Brazilian Jiu-Jitsu academy at 130 Brixton Hill, London SW2 1RS, run by Reiss Bailey BJJ Ltd, company number 13642905, registered address C, 11 Bullen Street, London SW11 3ER ("we", "us", "our").
1.2 You can contact us through the messaging feature in your Gymdesk account, by email at Reiss@newschoolbjj.com, or by phone or WhatsApp on 07578 284838.
1.3 These terms apply to every trial, membership, package, drop-in class, kids programme and kit purchase. They form a contract between us and you (or, for a child, between us and the parent or guardian who signs up). You accept them when you sign up online, through Gymdesk or at the gym. Our privacy notice explains how we use personal information.
1.4 Nothing in these terms affects your legal rights as a consumer.
2. Joining
2.1 To train with us you must create a Gymdesk account, accept these terms, sign our waiver and complete the health questionnaire in your student profile accurately.
2.2 Adult classes are open to people aged 14 and over. If you are 14 to 17, a parent or guardian must also accept these terms.
2.3 Kids classes are for children aged 4 to 12: Cubs (4 to 7) and Juniors (8 to 12). A parent or guardian must sign up on the child's behalf and is responsible for complying with these terms.
2.4 Memberships are personal to you and can't be shared or transferred.
3. Adult first month (trial)
3.1 Your first month costs £20 and gives you unlimited classes on the adult timetable, suitable for your level, for 30 days from the date you sign up.
3.2 Unless you cancel before the end of the 30 days, your membership will continue automatically as a monthly membership at £70 a month (2 classes a week), taken by card through Gymdesk on the day after your first month ends and then monthly on that date. You can choose unlimited membership at £95 a month instead by telling us before your first month ends.
3.3 You can cancel at any time, including during your first month, by letting us know (see section 8). Once you cancel, no further payments will be taken. Your 14-day cancellation right is explained in section 7.
4. Memberships and payment
4.1 Our monthly memberships are:
- 2 classes a week: £70 a month; and
- unlimited classes: £95 a month.
4.2 A single drop-in class costs £15, paid when you book.
4.3 Monthly memberships roll on from month to month until cancelled under section 8. There is no minimum term after your first month.
4.4 Membership fees are paid monthly in advance by card through Gymdesk, with payments processed by Stripe, on your billing date. By signing up, you authorise us to take each payment as it falls due until your membership ends.
4.5 If a payment fails, we'll tell you and try again. We may pause your bookings until the payment is made. If a payment is still outstanding after 14 days, we may end your membership under section 16 and recover the amount due.
4.6 There is no joining fee for new members. A re-joining fee applies in the circumstances in section 9.
5. Packages, Klarna and Clearpay
5.1 From time to time we offer membership packages covering a fixed period, paid up front. The price, length and what's included will be shown when you buy.
5.2 Where offered, you may pay for a package using Klarna or Clearpay. Any such arrangement is a separate agreement between you and Klarna or Clearpay, on their terms and subject to their eligibility checks. We are not a lender and do not give credit. If you are due a refund on a package paid this way, we will process it back through the same provider.
5.3 Unless the package says otherwise, a package doesn't renew automatically. When it ends, you can buy another package or move to a monthly membership.
6. Price changes
6.1 We may change our prices from time to time. We will give you at least 30 days' notice by email or through Gymdesk before a price change applies to your membership.
6.2 If you don't want to continue at the new price, you can cancel under section 8 before the change takes effect. Price changes don't affect a package or a kids programme instalment plan you have already bought.
7. Your 14-day right to cancel
7.1 If you sign up online, by phone or otherwise away from the gym, the Consumer Contracts Regulations 2013 give you the right to cancel within 14 days of the day the contract is made, without giving a reason.
7.2 By booking or attending a class during those 14 days, you ask us to start providing services straight away. If you then cancel within the 14 days, we will refund what you have paid, less a proportionate amount for the services provided up to the date you told us you were cancelling, and less the cost of any kit you keep (see 7.4).
7.3 To cancel, send us a clear statement, for example a message through Gymdesk or an email. We'll refund you within 14 days of receiving your cancellation, using the payment method you used.
7.4 If you bought kit online, such as a gi, you can also cancel that purchase within 14 days of receiving it. Return it to the gym unworn, unwashed and in its original condition within 14 days of cancelling and we'll refund you within 14 days of getting it back. If kit was included in a programme or package and you keep it, we may deduct its normal retail price from your refund.
7.5 This right doesn't apply to contracts you make in person at the gym, but you can still cancel a monthly membership at any time under section 8.
8. Cancelling your membership
8.1 You can cancel a monthly membership at any time, with no notice period and no cancellation fee. Just let us know through Gymdesk, by email to Reiss@newschoolbjj.com, or in person at the gym.
8.2 Once you cancel, no further payments will be taken. Payments already taken aren't refunded, but you can keep training until the end of the period you've paid for.
8.3 We'll confirm your cancellation in writing so you have a record of it.
8.4 Apart from your rights under section 7 and section 18, payments for months that have started aren't refundable, including where you don't use your membership.
8.5 Kids Intro Programme cancellations are covered by section 10.
9. Freezing and re-joining
9.1 Instead of cancelling, you can freeze your monthly membership for £25 a month. While frozen, you keep your Gymdesk account and class history, access to our members' WhatsApp group, and can come to community socials and events, but you can't attend classes.
9.2 To freeze or unfreeze, message us through Gymdesk before your next billing date. The frozen rate applies from that billing date.
9.3 If you cancel and later re-join, a re-joining fee of £75 is payable. It isn't charged if you freeze instead of cancelling.
10. Kids Intro Programme
10.1 Your child's first trial class is free.
10.2 The Kids Intro Programme lasts 4 months and includes a gi for your child to keep. You can pay:
- £100 for the first month (including the gi), then £75 a month for months 2, 3 and 4 (£325 in total); or
- £300 in full at the start.
10.3 A 20% discount applies to the programme fees for each brother or sister who joins.
10.4 The programme is a 4-month commitment. If you pay monthly and end it early, at any point after your 14-day cancellation period, an early leaving charge of £150 is payable and no further monthly instalments will be taken. If you paid in full, you can leave at any time with no early leaving charge; because the programme has been paid for up front at a discounted price, no refund is given for the remaining months. The charge reflects the cost of the gi, the place we hold for your child and the planning of the programme.
10.5 When the programme ends, your child moves on to our Advanced Kids programme at £75 a month, which runs as a rolling monthly membership under sections 4, 6, 8 and 9.
11. Kids: supervision, drop-off and pick-up
11.1 Parents and guardians are responsible for their child before their class starts and from the moment it ends. Please arrive no more than 10 minutes before class and collect your child promptly at the end.
11.2 Please walk your child into the gym and hand them over to the coach, and tell us in advance if someone else will be collecting them. We will not allow a child to leave the gym on their own unless you have given us written permission in advance.
11.3 Keep your child's health information and emergency contact details up to date, and tell the coach about any injury, illness or change before class.
11.4 Children are expected to listen to coaches, train safely and treat others kindly. If a child's behaviour puts others at risk, we will talk to you and may suspend or end their place under section 16.
12. Kit and loaner gis
12.1 Most adult classes are taught in the gi. In your first week (7 days from your first class), we will lend you a gi free of charge. After that, a loaner gi costs £10 each time you borrow one, or you can bring your own.
12.2 Loaner gis must be returned at the end of the class. If one isn't returned, or is damaged beyond normal wear, we may charge a reasonable replacement cost.
12.3 NSBJJ gis are fitted in person at the gym. Kit isn't posted and must be collected from the gym. Your rights if kit is faulty or not as described are set out in the Consumer Rights Act 2015.
13. Booking, classes and timetable changes
13.1 Classes must be booked through Gymdesk. If a class is full, you can join the waiting list. If you can't attend a class you've booked, please cancel the booking so someone else can take the space.
13.2 Some classes have entry requirements. Beginners can start at a 6pm fundamentals class on Monday, Tuesday, Thursday or Friday, or Sunday 1pm (1 to 2:30pm), beginners welcome. For example, Advanced classes are for coloured belts (white belts by invitation). Coaches may ask you to attend a different class if that's safer or better for your development.
13.3 We may change the timetable, class content or coach, and may close the gym for bank holidays, events, maintenance or reasons outside our control. We'll give as much notice as we reasonably can through Gymdesk. If the gym is closed for more than 7 consecutive days (other than over Christmas and New Year, when we'll publish our opening times in advance), we'll offer you a pro-rata credit or extension.
14. Health, safety, injury and hygiene
14.1 Brazilian Jiu-Jitsu is a contact sport that involves physical exertion, grappling and joint locks and chokes. It carries a risk of injury. You take part voluntarily and should train within your own limits.
14.2 You must tell us about any medical condition, injury, pregnancy or medication that could affect your safety or anyone else's, both when you join and whenever it changes. We may ask for a doctor's note before you train, and we may stop you training if we reasonably believe it isn't safe.
14.3 Don't train if you are unwell, injured, or under the influence of alcohol or drugs. Tap early, follow coaches' instructions at all times, and report any injury to a coach straight away so we can help and record it.
14.4 To keep the mats clean and safe for everyone:
- wear a clean gi or training kit every session, with a t-shirt or rash guard underneath;
- keep fingernails and toenails short and remove jewellery before training;
- cover any cuts or grazes;
- never walk on the mats in shoes, and wear footwear whenever you step off the mats, including to the toilets; and
- don't train with any skin infection (such as ringworm, impetigo or herpes), cold sore or contagious illness until it has cleared or a doctor confirms you are not contagious.
15. Conduct
15.1 We're a team, and everyone should feel welcome. You must treat members, coaches, staff and visitors with respect, train with control, and follow our house rules and coaches' instructions.
15.2 We do not tolerate violence outside of supervised training, bullying, harassment, discrimination, abusive language, theft or damage to property, on the premises, at events or online in connection with the gym.
16. Refusal, suspension and termination
16.1 We may refuse a membership application, or refuse entry to a class, where we reasonably consider it necessary for safety or for the wellbeing of other members.
16.2 We may suspend or end your membership, with immediate effect where necessary, if you seriously or repeatedly break these terms, if a payment remains unpaid for more than 14 days after we have contacted you, or if you put the safety of others at risk. If we end your membership for one of these reasons, no refund is due for the current period, but you won't have to pay for future periods.
16.3 We may also end your membership for any other reason by giving you at least 30 days' notice. In that case we will refund any amount you have paid for the period after your membership ends.
17. Photos and filming
17.1 We sometimes take photos and video at classes, gradings, competitions and events to use on our website and social media. If you'd rather not appear, or you don't want your child to appear, tell a coach or message us and we will respect that. Our privacy notice explains how we use images.
17.2 You may film your own training for personal use with the coach's permission. Please don't photograph or film other members without their consent, and don't photograph or film children other than your own.
18. Our liability to you
18.1 We will provide our services with reasonable care and skill. If we don't, you have legal rights under the Consumer Rights Act 2015, which may include asking us to put things right or, in some cases, a price reduction.
18.2 We do not exclude or limit our liability for death or personal injury caused by our negligence or that of our coaches or staff, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to exclude or limit.
18.3 We are not responsible for loss or damage that was not reasonably foreseeable when the contract was made, or for loss of, or damage to, personal belongings brought to the gym, unless caused by our negligence. Please don't leave valuables unattended.
18.4 We are not responsible for delays or failures caused by events outside our reasonable control, but we will tell you as soon as we can and take reasonable steps to minimise the effect.
19. Complaints
19.1 If something has gone wrong, please message us through Gymdesk or email Reiss@newschoolbjj.com with your name, contact details, a description of what happened, the relevant dates and anything that supports your complaint.
19.2 We aim to acknowledge complaints within 72 hours and to send a full response within 7 to 10 working days. If you think you've been charged by mistake, tell us and we'll reply within 48 hours.
20. General
20.1 We may update these terms, for example to reflect changes in the law or how we run the gym. We will give you at least 30 days' notice of any change that materially affects you, and you may cancel before it takes effect. The latest version will always be on this page.
20.2 If a court decides that any part of these terms is unenforceable, the rest will continue to apply.
20.3 Nobody other than you and us has any right to enforce these terms under the Contracts (Rights of Third Parties) Act 1999.
20.4 If we don't enforce a right straight away, we can still enforce it later.
20.5 These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
